The hand brake to performance or the oil to an efficiently run machine?

Chapter 5 Motor vehicles.

Background: Since September 2013, all new vehicles in South Africa are required, by law, to be fitted with microdots. The initiative, widely supported by SAPS, as a way of reducing the risk of fraud (vehicle cloning) by providing all vehicle dealing services (from Pre-Owned Dealers to SAPS and Boarder Control) with the ability to identify and verify a VIN and its connected parts. With that the onus is placed on traders of used vehicles to ensure that they are trading in authentic goods as per the 2nd Hand Goods Act. This measure also protects innocent buyers from unknowingly purchasing stolen goods.

Method of compliance: All vehicle Dealers/traders need to inspect whether a vehicle has microdots and whether the secret code (PIN) on the microdot matches the VIN through a secure web-service. Records of the microdot shall be kept as part of the acquisition and disposal documentation.

Compliance, often only seen as a cost burden, does not have to be in this case; “On-the-road fees” and “verification added products” can cover expenses. A major consideration is the financial loss from unknowingly purchasing a cloned vehicle is not recoverable—and exposes both businesses and buyers to unnecessary financial risk.

Pros of Compliance

    • Cost Savings: By adhering to regulations, companies can avoid costly non-compliance fines, legal fees, and potential business shutdowns.
    • Reputation: A strong compliance program builds trust with clients and stakeholders, cultivating brand loyalty and a contributing to your enhanced public image.
    • Operational Efficiency: Implementing robust compliance processes can enhance operations, reduce fraud, and improve overall business performance.
    • Risk Mitigation: Compliance programs help identify and mitigate potential legal, financial, and reputational risks associated with failing to meet industry standards and laws.
    • Competitive Advantage: A strong compliance program builds trust in your brand, attracting loyal customers while deterring criminals from attempting fraud—ultimately giving your business a clear edge in the marketplace.

Cons of Compliance

    • Resource Drain: Achieving and maintaining compliance demands considerable time, financial investment, and dedicated personnel to implement and uphold business policies and procedures.
    • Administrative Burden: The paperwork, training, and ongoing monitoring can be burdensome.
    • “Check-the-Box” Mentality: If approached as a mere formality rather than a core business value, compliance efforts can be superficial and fail to deliver true long-term benefits.

The relevance is obvious as consideration of the high crime and fraud rates in South Africa it is imperative that support of the police is provided and the cutting out of the possible channels criminal’s exploit. While it may require additional checks at the trading level, the only responsible choice is to contribute to the solution rather than the problem.
